    An initial consultation, up to one hour, is FREE for general estate planning, estate administration, probate, GUARDIANSHIP or a family law matter if you bring your completed Questionnaire with attachments and all decision-makers attend; otherwise, we charge by the hour.  An initial consultation for long term care planning with Medicaid &/or VA Pension costs $500.  We charge by the hour, in one-tenth of an hour (6 minute) increments, for all time spent on real estate, corporate and other business matters, or for any advice outside the initial consultation when you have not engaged us under a flat fee agreement.  Any quote we give you for a flat fee is binding if we receive all requested information and are engaged to commence work within 30 days.  We accept Visa and MasterCard but assess a 2% surcharge when doing so.  Please come to any initial consultation prepared to pay the initial consultation charge (for Medicaid/VA, real estate, etc.), and/or one-half of any flat fee, or a retainer for hourly work.

Commercial Real Estate

Whether you’re contemplating the purchase or sale of real estate, or its development as a shopping center, restaurant, condominium regime or residential subdivision, an attorney with extensive experience in this field is an essential partner to help you avoid pitfalls and protect your interests.  We can be most effective if you involve us before you sign the purchase and sale agreement but we will jump in and do our best from any stage.  We help clients negotiate the purchase contract, alert them to critical dates, review the survey and title insurance commitment, including the restrictive covenants, easements and encumbrances imposed against the land, and otherwise guide our clients, always listening and responding to questions and concerns, until we oversee a smooth closing and celebrate the completion of the project. We will also act as borrower’s counsel and review loan documents, and advise you regarding any egregious terms. Alternatively, we will draft loan documents on behalf of a lender to conform to the terms of the loan commitment, and work to see that the loan is properly secured. We frequently work in cooperation with real estate brokers; they take the lead on negotiating the financial terms of the deal while we work to see that your contract reflects those terms and gives you the legal protection you need. We represent buyers, sellers, borrower, lenders and developers and would be pleased to represent you.

 

Leases

Whether you are the landlord or the tenant, Ball Corley PLLC is available to assist with your leasing needs.  We will create a standard lease form for a commercial or residential landlord, review and update an existing lease, help a tenant understand and negotiate legal provisions of a lease tailored to your needs, or simply advise you on the legal terms and issues associated with your transaction.

 

Residential Real Estate

With historically low interest rates, many people have the opportunity to own their first home or upgrade to the new home of their dreams. However, many buyers and sellers, both experienced and inexperienced, take an unnecessary risk by signing an offer and acceptance provided by the real estate broker – not a licensed attorney.  If the realtor's form does not describe the transaction as the parties intended, or a buyer or seller does not understand what it says, it may cost thousands of dollars in legal fees to either correct the transaction or avoid the agreement altogether.  Hiring an experienced attorney to draft necessary documents or to, at the very least, explain, from a legal perspective, the offer and acceptance, plus the financial documents, during the home buying/selling process, will provide information to help you understand all aspects of your transaction. Even when working with a highly skilled realtor, you should bring in an attorney if you have issues regarding easements, encroachments, party walls and other atypical issues, or if you need significant variances from the standard form contract.

If you would like our assistance with your real estate transaction, please request a consultation. Bring with you the deal terms, any deeds, surveys and tax assessments you have for the subject property, and any other information you have. We will meet with you and answer any questions, and give you an idea of what we believe your project entails. If you engage us, we will ask you to sign an Engagement Agreement and pay an advance fee deposit against which we will bill our time at our standard rates on an hourly basis, in one-tenth of an hour (6 minute) increments. You may be asked to replenish this deposit from time to time as fees are earned. If the matter is concluded without us earning all money then on deposit we will promptly refund any excess. We will accept a Visa or MasterCard but we assess a 2% surcharge when doing so. We do not offer a free consultation with respect to real estate matters since we can often answer your questions in our initial meeting. In that event, you may pay us for our time at the conclusion of the meeting and no further deposit will be required.
